Terms of Service

These Terms of Service ("Terms") explain how The Moment Savers provides photography and cinematography services and what you can expect when you book us.

Effective Date: October 19, 2025 — By booking or using our services you confirm that you have read, understood, and agree to these Terms.

1. Acceptance of Terms

By requesting a quote, booking a session, or using any services provided by The Moment Savers (the "Company"), you agree to be bound by these Terms of Service and any documents they reference. If you are booking on behalf of another person, you confirm that you are authorized to enter into this agreement.

2. Our Services

The Moment Savers provides wedding photography, cinematic wedding films, editorial shoots, engagement shoots, destination wedding coverage, drone/aerial filming, and related creative services (collectively, the "Services"). Details of deliverables, timelines, and specific services are set out in your written quotation or contract.

3. Booking, Quotes & Confirmation

a) Quote: We provide a written quote outlining services, fees, travel costs, and any optional add-ons. Quotes are valid for 14 days unless otherwise stated.

b) Deposit & Confirmation: Bookings are confirmed only after a signed agreement and receipt of the specified deposit (commonly 25%–30% of the total fee). The deposit ensures your date is reserved and is non-refundable except as set out in these Terms.

c) Final Agreement: The written agreement between you and The Moment Savers governs the Services. Any variation must be agreed in writing.

4. Payment Terms

a) All fees are payable in Indian Rupees (INR) unless otherwise agreed. The balance is typically due before delivery of final assets, or as defined in your contract.

b) Payment methods accepted include bank transfer, UPI, or other methods specified in your invoice. Clients are responsible for any transaction fees.

c) If payment is overdue, The Moment Savers reserves the right to withhold deliverables until payment is received.

5. Cancellation, Postponement & Refunds

a) Client Cancellation: If you cancel more than 60 days before the event, we will retain the deposit and refund any additional amounts paid (unless otherwise agreed). If cancellation occurs within 60 days of the event, the deposit is retained and additional cancellation fees may apply due to lost opportunities and pre-arranged commitments.

b) Rescheduling: We will make reasonable efforts to accommodate rescheduling requests. Rescheduling within 30 days of the event may incur additional fees.

c) Refunds: Refunds (where applicable) will be processed within 14 business days via the original payment method, subject to contract terms.

6. Deliverables & Timeline

a) Typical delivery timelines are listed in your contract (commonly edited images in 4–6 weeks, films within 8–10 weeks). Timelines may vary during peak season.

b) The Moment Savers will make commercially reasonable efforts to deliver on time. Any changes to delivery dates will be communicated promptly.

7. Intellectual Property & Usage Rights

a) Copyright: The Moment Savers retains copyright to all images, films and creative works produced unless an alternate written agreement is in place.

b) License to Client: Upon full payment, we grant the client a non-exclusive, non-transferable license to use the delivered images and films for personal, non-commercial use (social media, prints, personal albums). Commercial usage, resale, or licensing to third parties requires a separate written agreement.

c) Portfolio Usage: We reserve the right to use images and footage for our portfolio, website, social media, marketing materials, and competitions unless you request in writing that certain images not be used.

8. Model Release & Location Permissions

a) By booking, you grant The Moment Savers permission to use images and footage as described above for promotional purposes unless specifically restricted in writing.

b) Clients must ensure the venue or property owners grant necessary permissions for photography, filming, and drone use. The client remains responsible for any fines or restrictions arising from lack of permissions.

9. Drone Filming & Safety

If drone or aerial services are part of the package, we will comply with applicable rules and safety guidelines. Extra charges may apply for permits, operator travel, or restricted locations. We reserve the right to cancel aerial filming due to safety, weather, or regulatory restrictions.

10. Client Responsibilities

a) Clients should provide accurate event details (timings, locations, guest counts) and inform us of any special requirements or cultural considerations.

b) The client is responsible for providing meals, safe workspaces, and reasonable access for our team during the event as agreed.

11. Limitation of Liability

a) The Moment Savers will not be liable for indirect, incidental, or consequential losses, lost profits, or loss of data.

b) The total liability for any claim arising out of or in connection with our Services shall not exceed the total fees paid by the client for the specific event or package.

12. Indemnity

You agree to indemnify, defend, and hold harmless The Moment Savers, its owners, employees, and contractors from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the deliverables.

13. Privacy & Data

We collect personal information necessary to perform the Services and contact you. Our Privacy Policy (linked on the site) explains how we store, use, and secure your data. By agreeing to these Terms you also consent to the collection and processing of personal data as described in our Privacy Policy.

14. Third-Party Services

We may use third-party vendors for printing, album manufacture, or cloud delivery. While we choose trusted partners, we are not responsible for their internal processes. Any third-party service terms are additional to these Terms.

15. Force Majeure

Neither party will be liable for delays or non-performance caused by events beyond reasonable control (e.g., natural disasters, acts of government, pandemics). In such cases, we will work with you to reschedule or agree next steps in good faith.

16. Termination

Either party may terminate the agreement for material breach if the other party fails to remedy the breach within 14 days of written notice. Termination does not relieve the client of any payment obligations for Services already provided.

17. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated on our website or via direct communication. Continued use of our Services after changes constitutes acceptance of the updated Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Ajmer, Rajasthan.

20. Disclaimer

While we aim to produce the best creative results, we cannot guarantee specific subjective opinions, outcomes, or social media reactions. The images and films are artistic interpretations and may vary in style.

21. Acceptance & Signature

By signing a separate service agreement or paying the deposit, you acknowledge you have read and agree to these Terms. If you are signing as a representative, you confirm you have authority to bind the party you represent.
